Terms of Service

1. Acceptance

By accessing or using Hook ("the Service") at beta.askhook.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Hook is a trading name of Markt AI Ltd (company number 16133663), registered office 128 City Road, London EC1V 2NX, United Kingdom, a subsidiary of Hook AI, Inc. (Delaware, USA) (together, "Hook", "we", "us"). These Terms form a binding agreement between you and Markt AI Ltd.

2. Description of Service

Hook is a social and creative intelligence platform. It collects publicly available content from social platforms (including Instagram, TikTok, YouTube, LinkedIn, X, and Facebook), analyses that content using AI, and turns it into competitive benchmarks, creative blueprints, video-level breakdowns, and an AI assistant. Features include ecosystem and competitor tracking, creative analysis, an AI assistant, an AI scriptwriter, and a workspace knowledge base.

3. Accounts and Workspaces

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • Workspace admins are responsible for all activity within their workspace, including the actions of invited members.
  • You must be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Use data or insights obtained through Hook to harass, stalk, defame, or contact creators or individuals without a lawful basis.
  • Attempt to scrape, reverse-engineer, or extract data from Hook beyond what normal use of the Service provides.
  • Resell, sublicense, or redistribute Hook's data outputs to third parties without written permission.
  • Use the Service in a way that violates the terms, community guidelines, or intellectual property rights of the social platforms whose public content is analysed.

5. Publicly Available Content

Profiles, metrics, posts, and analyses surfaced in Hook are derived from publicly available content collected from third-party social platforms and processed by AI. This data and the insights generated from it are provided for internal research and campaign-planning purposes only. Hook makes no warranty as to the accuracy, completeness, or currency of this data or of AI-generated outputs, and you are responsible for how you use them, including compliance with applicable law and the relevant platforms' terms.

6. Intellectual Property

The Hook platform, including its software, design, and models, is owned by Hook and protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes. Nothing in these Terms transfers ownership of any intellectual property to you. Content you upload to your workspace remains yours; you grant us the rights needed to host and process it to provide the Service.

7. Billing and Cancellation

  • Paid subscriptions are billed monthly or annually in advance and renew automatically until cancelled.
  • You may cancel at any time. Cancellation takes effect at the end of the current billing period, and your access continues until then.
  • If you are a consumer (an individual acting outside your trade, business, or profession), you have a statutory 14-day right to cancel and receive a refund under the UK Consumer Contracts Regulations 2013, except where you have asked us to begin the service immediately and acknowledged that you lose that right once it has been fully performed. Business customers are not entitled to a statutory cooling-off period, and other than as required by law refunds are not issued for partial billing periods.
  • Hook reserves the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.

8. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Hook does not guarantee that the Service will be uninterrupted, error-free, or that any particular result will be achieved.

9. Limitation of Liability

To the maximum extent permitted by law, Hook shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the Service. In no event shall Hook's total liability exceed the amount you paid to Hook in the 12 months preceding the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

10. Termination

Hook may suspend or terminate your access to the Service at any time for breach of these Terms, non-payment, or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
